The Consolidated Appropriations Act of 2021 requires brokers and consultants to disclose both direct and indirect compensation before entering into agreements with employer health plans. The CAA 2026 expanded and clarified who qualifies as a “covered service provider” and pulling more services, more vendors, and more compensation arrangements into scope.
Commissions, bonuses, overrides, revenue sharing - if it’s connected to the plan, it needs to be disclosed.
